The challenge is to the employee being declared surplus. Same is objected on the ground that the Management has another school and by clubbing the strength the said employee could have been retained on the post.

To justify the aforesaid claim it is urged that the total strength of the students is 700 which the respondent has failed to take into account.

As far as the aforesaid contentions are concerned, while passing the order impugned the respondent-Education Officer has called all the information pursuant to the communication dated 24.12.2024 and 31.12.2024 and has taken into account all the relevant factors including that of the strength of the students. 6.

There is hardly any material on record to infer that the decision of the respondent is contrary to the statutory mandate provided in regard to declaring an employee surplus.
