Though by an interim order dated 16.10.2024 in Writ Petition No.8001/2019, Pawan S/o Ramkrushna Gawande & Ors. Vs. State of Maharashtra & Ors., the statement of the learned AGP was recorded, which is as under:

"5. The learned AGP does not dispute that in view of the Government Resolution dated 18.07.2018, the

2 918.WP.343-2025 & ANR..odt persons with disabilities, who have been wait listed, will have to be accommodated in the vacancies, which have occurred throughout the State. He further submits that the respondent No.2, has undertaking an exercise, to determine the vacancies in this category and the candidates eligible for absorption in those vacancies."

In view of which, we had directed that no vacancies shall be filled in the category of persons with disability on the basis of NOC which may have been issued by the Deputy Secretary, Persons with Disabilities Welfare Department, without leave of this Court. The learned AGP has filed a reply in Writ Petition No. 343/2025, in which in para 13 (page 66), it is stated, that at present there is no such surplus employee found to be eligible for absorption on the official website of the Commissioner. This would indicate, that nothing has been done, in pursuance to the undertaking as recorded in the order dated 16.10.2024, to prepare the waiting list of eligible persons by the concerned authority. 3.

List the matters on 03.04.2025 for the learned AGP to address the Court on this, as we find that this is a serious infraction of the earlier order of this Court. (ABHAY J. MANTRI, J.) (AVINASH G.
