Having heard learned counsel for the petitioner for sometime, the purpose of filing petition will be served, if the Trial Court is directed to first decide the application filed by the petitioner / plaintiff seeking amendment to the plaint and thereafter to decide the application (Exh.5). 2.

The respondent / defendant shall file reply to the application seeking amendment within eight working days from today and furnish copy of reply to the petitioner's counsel. 3.

Application shall be then decided by the Trial Court as expeditiously as possible and preferaly within two weeks from the date of filing reply.
