Heard the learned Counsel for the petitioners. 02.

The petitioner's challenge is to the order dated 10/12/2024 passed by the Industrial Court, Nagpur in Misc. Application (PGA) No.38/2024, by which the petitioners' application for condonation of delay in filing the appeal under Section 7 of the Payment of Gratuity Act, 1972 came to be rejected. It is pointed out that an identical controversy has already been decided by this Court by judgment dated 06/01/2026 in Writ Petition No. 8504/2025 with connected matters. The identical controversy was decided by this Court by considering position of law laid down in the matter of Pharma Base India Ltd. vs. State of Maharashtra & another, reported at 2009(1) Mh.L.J. 688.

The controversy involved in the present petition being identical and covered by the said judgment and, therefore, for the reasons recorded in the said judgment, the instant writ petition is dismissed. There shall be no order as to costs.
