The dispute is that the petitioner failed to appear before the Court below and, therefore, suffered order of 'No CrossExamination'. The counsel for the petitioner submits that this would infringe right to defend the suit, the petitioner being defendant before the Court below.

True it is that the order of No Cross Examination will have far reaching effects. At the same time, it is the duty of the litigants and their counsel to appear before the Court on the scheduled date. Both failed repeatedly to appear before the Court. 4.

Considering above circumstances, let the petitioner deposit Rs.50,000/- to show his bona fides. Upon depositing the amount, issue notice before admission to the respondent, returnable in three weeks. The petitioner is at liberty to get the petition circulated for interim relief upon depositing the amount.

Copy of the order be served on the Trial Court for information.
