The present petitioners have made application, seeking enhancement of compensation, in view of adjudication of reference under Section 18 of the Land Acquisition Act, 1894 (for short hereinafter referred to as "LA Act") in favour of another land owner whose land was also acquired for the same project under the same Section 4 Notification. However, application under Section 28A of the LA Act is admittedly filed beyond the period of seven years from the date of judgment and award by the learned Reference Court.

In view of the aforesaid, the impugned order, rejecting application for enhancement of compensation under Section 28A of the LA Act does not warrant interference. 3.

In view of the aforesaid position, learned Advocate for the petitioners, on instructions from the petitioners, makes a motion to withdraw the petition with

34. WP 551 of 2026.odt liberty to make fresh application under Section 28 A of the LA Act after first appeal arising out of judgment delivered by the learned Reference Court is decided.

Writ Petition is disposed of as withdrawn with liberty as prayed. No order as to costs.
