Heard learned Counsel for the parties for some time.

The issue involved is whether the pensionary benefits to the Respondent No.1 are payable in terms of the
2 13.WP.562-2025 & ORS..odt provisions of Payment of Gratuity Act, 1972 or the provisions of the Maharashtra Civil Services (Pension) Rules, 1982. The Coordinate Bench of this Court in the case of Chief Executive Officer Vs. Ganesh Gulabrao Nawale in Writ Petition No. 2596/2024 decided on 09.06.2025, has taken a view that the provisions of Payment of Gratuity Act, 1972 will be applicable. Accordingly, the petition was dismissed. 3.
In that view of the matter and for the reasons stated in Chief Executive Officer (supra), the present Petitions are dismissed.

The learned Counsel for the Petitioners, submits that the amount payable to the Respondent No.1 is deposited with the Court in terms of order dated 30.01.2025. 5.
The amount shall be released to the Respondent No.1 upon making usual application.
