The petitioner has approached this Court seeking challenge to the impugned notice dated 28th April, 2025. It appears that the notice pertains to action proposed against the petitioner, for failure to deposit the amount which was required to be deposited, on 17th May, 2025. The present petition, filed on 23rd December, 2025, is listed today before this Court. 3.

In our considered opinion, in view of the fact that the execution of the aforesaid notice was on 17th May, 2025, the challenge to the impugned notice dated 28th April, 2025 has lost its efficacy.

Accordingly, the present petition is disposed of as infructuous, with liberty to the petitioner to approach this Court as and when occasion arises.

The petitioner submits that he has already challenged the arbitral award dated 25th March, 2017 before the learned

104.WP.663.2026 2/2 District Judge. The petitioner is also at liberty to file an application for stay in the aforesaid arbitral proceedings so that no recovery is issued against the petitioner.
