Prior to the appointment of the petitioner as a Staff Nurse from Scheduled Tribe Category on 26.08.2024, it is urged that the petitioner has already applied for issuance of Caste Certificate, which is informed to have been not decided till this date.

Issue notice to the respondents.

Mr. M. Bute, learned Counsel waives notice for respondent No.1 and 2.

Ms S. S. Jachak, learned Additional Government Pleader waives notice for respondent No.3.

The petitioner to appear before the respondent No.3 with all the documents on 24.02.2025 and the respondent No.3 shall within a period of four weeks communicate the order as regards issuance of the Caste Certificate.

If the order adverse to the interest of the petitioner is passed, it shall be open for the petitioner to prefer an appeal under the Maharashtra Scheduled Castes, Scheduled Tribes, De-Notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000 before the Committee immediately.

Stand over to 21.03.2025.

We direct the Additional Government Pleader to make statement on the next date about development in the matter.

Till then, no coercive action shall be taken against the petitioner.
