In the present writ petition, the order dated 22.01.2025 passed by the Tahsildar under the provisions of Maharashtra Restoration of Lands to Scheduled Tribes Act, 1974 is under challenge, whereby the land in question is directed to be handover to the Government.

Since the appeal/revision against such order is provided under Section 247 of the Maharashtra Land Revenue Code, 1966, we are not inclined to entertain the present writ petition.

At this stage, the learned counsel for the petitioner, on instructions, seeks permission to withdraw the present writ petition with liberty to approach to the appellate authority.

The learned counsel for the petitioner further submits that the period that the petitioner spent in pursuing this writ petition shall be considered, while considering the point of limitation.

In view of the above, the writ petition is disposed of, as withdrawn, with liberty as prayed for. 7.

If the appeal/revision is filed within three weeks from today, the appellate authority shall take into consideration the period spent, in pursuing the present writ petition, while considering the point of limitation. 8.

If such appeal/revision is filed the authority is directed to decide the same within six weeks from the date of filing, in accordance with law.
