Heard the learned counsel for the petitioners. 2.

The petitioners have approached this Court seeking a direction to respondent No.1-Collector, Nagpur (Guardian, Court of Wards), Nagpur, to expeditiously decide the application filed by the petitioner under Section 24 of the Central Provinces Court of Wards Act, 1899, for cancellation of the mutation entry standing in the names of respondent Nos.4 to 11 in respect of the land bearing Survey No.29/1, Mouza Somalwada, Tahsil Nagpur (City), District Nagpur.

The learned counsel for the petitioners submits that the said application filed by the petitioners is at page 27, Annexure-D. Perusal of the said application reveals that it was submitted to respondent No.1 on 08.05.2023. However, despite the lapse of more than two and a half nd.thawre

2/2 years, the application seeking cancellation of the mutation entry in the name of respondent Nos.4 to 11 has not yet been decided. Consequently, there exists a likelihood of creation of third-party interest in respect of the aforesaid property.

In view of the above, we direct the respondent No.1 to decide the application submitted by the petitioners on 08.05.2023, within eight weeks from the date of receipt of this order.

The learned counsel for the petitioners undertakes to furnish copy of this order to the respondent No.1 within two weeks from today.

The decision taken shall be communicated to the petitioners within two weeks from the date of such decision.

Accordingly, the writ petition is disposed of in the above terms. No order as to costs.
