2] The contention is that despite in spot inspection carried out by the Deputy Superintendent of Land Records on 11/10/2023 and in the report submitted by the Talathi on 17/10/2023, both the authorities have mentioned that in the measurement carried out on the spot, encroachment was found to be not made by the petitioner, the authorities below have, on the basis of the said two reports, noted that the petitioner has encroached upon the government road and disqualified the petitioner as Sarpanch of Gram Panchayat - Silli, Tahsil and District - Bhandara. This finding, according to the petitioner's Counsel, is contrary to the reports relied upon by the authorities below. He further submits that the petitioner is the wife of a person, who is said to have made encroachment, which plot is given to some other person on rent to run a School, which is the fact put forth by respondent no.6 - original plaintiff.

5] In the meantime, there shall be stay to the impugned order dated 31/1/2025 passed by the Additional Commissioner, Nagpur Division, Nagpur, in V.P.A.A. No. 146/2023-24.
