Heard Shri Ganesh Eknath Meshram, the petitioner-inperson for Petitioner No.1, and Shri Mir Nagman Ali, the learned counsel appointed for Petitioner No.2. 2.

The perusal of the present writ petition, which is filed in Marathi, reveals that the subject matter involved in the present writ petition is already sub judice before the learned Civil Judge Senior Division, Nagpur, in Special Civil Suit No.807 of 2017, which is pending. The reliefs sought in the present writ petition are against Respondent No.6 - Mundrika Mohan Sharma, who

2/3 is Defendant No.20 in the aforesaid suit, and the prayer clauses of the aforesaid suit reveal that the declaration as to the sale deed dated 04.08.2016 in favour of the present Respondent No.6, so also the construction carried out by her on the suit property, is already under challenge.

In view of the above, we dispose of the present writ petition with liberty to the present petitioners either to intervene in the aforesaid suit or initiate separate proceedings before the learned Civil Court against Respondent No.6, as various disputed questions of fact are involved in the present writ petition.

Accordingly, the writ petition is disposed of with liberty as prayed for.

It is pointed out by Shri Mir Nagman Ali, the counsel appointed for Petitioner No.2, that so far as the other reliefs in the present petition are concerned, that is regarding correction of maps, the measurement and the consequent addition of area in the property, the petitioners have already approached the Competent Authority by filing the proper applications and the said applications are pending for the aforesaid relief.
