Heard Shri. A. H. Daga, learned counsel for the petitioner and Shri. P. V. Navlani, learned counsel for respondent No.1 - Union of India.

The petitioner - company has approached this Court seeking a direction to the respondents to refund the amount of penalty recovered from it, which according to the petitioner was illegally imposed.

The contention is that the petitioner has already deposited the aforesaid amount of penalty under protest vide communication dated 29.05.2024, which is at record page No.150 (Annexure - 35). Shri. A. H. Daga, learned counsel for the petitioner, submits that the petitioner is covered by the provisions of Clause (5) of the Public Notice dated 17.06.2021 and as such, the penalty should not have been imposed upon the petitioner. Be that as it may, the respondents have not yet decided the claim of the petitioner for refund of such penalty. 4.

In view of the above, we dispose of the present writ petition with a direction to respondent No.1 to treat the present writ petition as a representation submitted by the petitioner for

106 WP-943-2026 refund of the penalty amount. The respondent No.1 is further directed to decide the said representation within a stipulated period of eight weeks from the date of receipt of this order. The respondent No.1 is also directed to consider the grounds raised in the present petition, more specifically the Public Notice dated 17.06.2021, which is at record page No.112, so also all other relevant documents placed by the petitioner alongwith the present writ petition for substantiating its claim for refund. The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision.
