Shri. D. P. Thakare, learned Additional Government Pleader, appeared and waived service of notice on behalf of respondents/State.

The petitioner - Management has approached this Court seeking a declaration that the provisions of the Maharashtra Self-Financed Schools (Establishment and Regulation) Act, 2012, are not applicable to the Minority Educational Institution. The petitioner claims to be such a Minority Educational Institution.

Shri. U. J. Deshpande, learned counsel for the petitioner, submits that the respondent No.4 - Deputy Director of Education (Primary), Amravati Division, Amravati, is the competent authority to decide such entitlement of the petitioner. 5.
In view of the above, we dispose of the present writ petition, in terms of the following order :

O R D E R
i) The petitioner - Management is directed to appear before respondent No.4 - Deputy Director of Education (Primary), Amravati Division, Amravati, on 16.02.2026 at 11:00 a.m. The petitioner to produce a copy of this order alongwith a copy of the present writ petition and its annexures before respondent No.4.
ii) Respondent No.4 is directed to treat the present writ petition as a representation submitted by the petitioner for claiming such relief of declaration. Respondent No.4 is further directed to grant a personal hearing to the petitioner before taking a decision and to consider the documents as well as the relevant judgments placed on record by the petitioner in support of its claim for such declaration. iii) Such decision shall be taken within a period of twelve weeks from the date of appearance of the petitioner before the respondent No.4 in accordance with law.
iv) The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision.
