The argument is that the Industrial Court has condoned the delay to permit the party to file application to review the Award dated 22/4/2022 in Ref. IDA No.03/2017. 3.

The learned Counsel for Petitioners has relied upon the Judgment passed by the Co-ordinate Bench of this Court in the case of Sudhir Janardhan Desai V/s Hyphosphite and Co. and others, 2004(4) Mh.L.J. 223, in support of his argument that powers of review are not available to the Industrial Court. Accordingly, he submits that when the Industrial Court has no powers to review the Award, there arises no question of condoning the delay to permit the party to file application to review the Award.
