Learned counsel for the petitioner relies on judgment in the matter of NTPC BHEL Power Project Private Limited Vs. Shree Electricals and Engineers (India) Private Limited reported in 2025 DGLS(Bom.)753 and submits that on excluding the period during which writ petition was pursued the period of delay is 106 days and thus the application for condonation of delay ought to have been considered in that perspective.
