Heard the learned counsel for the petitioner, the learned AGP for respondent Nos.1, 2, 4 and 7. 2.

None for the respondent Nos.3, 5 and 7.

In this petition, the petitioner is seeking declaration that she is governed by the Government Resolution (GR) dated 21/12/2019, which was superseded by GR dated 14/12/2022, which provides the manner in which the post retiral benefits along with service benefits consequent upon invalidation of the tribe claim are to be released. 4.

In view of subsequent GR, the petition can be disposed of by directding the respondents to consider the claim of the petitioner for payment of post retiral benefits KHUNTE

946-wp1084.25.odt 2/2 and also service benefits in terms of the GR dated 14/12/2022.

As such, the petition is allowed.

The respondents are directed to consider the claim of the petitioner for payment of post retiral benefits and service benefits in terms GR dated 14/12/2022. The decision shall be taken by the Competent Authority within a period of two months from the date of certified copy of the order being produced before it.

The petition stands disposed of in the above terms. No costs.
