Heard the learned counsel for the petitioners. 2.

The respondent No.5-District Superintendent of Land Records, Civil Lines, Nagpur, had passed an order on 31st January, 2013. Being aggrieved by the said order, the petitioners have approached the respondent No.4-Deputy Director of Land Records, Civil Lines, Nagpur, by filing an appeal under Section 247 of the Maharashtra Land Revenue Code, 1966. The respondent No.4 had partly allowed the said appeal vide order dated 11th February, 2015 and had quashed the aforesaid impugned order dated 31st January, 2013 passed by the respondent No.5 and had remanded the matter to the respondent No.5 for passing the order afresh. The said order is at record Page No.40 (Annexure-E). 3.

The learned counsel for the petitioners submits that in spite of the aforesaid order dated 11th February, 2015 passed by the respondent No.4Deputy Director of Land Records, Civil Lines, Nagpur, remanding the matter to the respondent No.5, the respondent No.5, even after passage of time of 11 years, has not passed any order in the application, afresh. In view of this, the petitioner, by way of prayer clause (iii) of this writ petition, seeks a direction to the respondent No.5-District Superintendent of Land Records, Nagpur, to decide the aforesaid application within a stipulated period.

In view of above, we dispose of the present writ petition with a direction to the respondent No.5-District Superintendent of Land Records, Nagpur, to decide the proceedings as mentioned in the order dated 11th February, 2015, which is at record Page No.40 (Annexure-E), passed by the respondent No.4-Deputy Director of Land Records, Nagpur, within a stipulated period of eight weeks from the date of receipt of the order of this Court, if the said proceedings are not decided earlier. The petitioners undertake to produce the copy of the order of this Court before the respondent No.5 within a period of one week from today. The decision taken thereupon shall be communicated to the petitioners within a period of two weeks thereafter.

If the aforesaid proceedings are already decided by the respondent No.5, the order passed by the respondent No.5 shall be communicated to the petitioners immediately.
