After arguing the matter for some time, learned Advocate for the petitioner, upon instructions, seeks permission to withdraw the instant petition with liberty to file a separate application under Section 9 of the Guardian and Wards Act, before the Family Court, for raising the issue of jurisdiction.

The petitioner is granted permission to withdraw the instant petition with liberty as prayed for.

In case, any such application is filed by the petitioner, the Family Court is directed to decide the same by considering the position of law, as applicable. 4.

In view of the above, the writ petition is disposed of as withdrawn.
