The Division Bench of this court in earlier round of litigation has directed the claim of the petitioner to be considered for grant of compassionate appointment in view of Supreme Court judgment in case of Kalpana Vilas Taram vs. State of Maharashtra and ors. 2024 (4) Mh.L.J. 312. 2.

The petitioner is the grand daughter and is seeking compassionate appointment by virtue of the Government Policy. Clause 3.6 of the Government Resolution dated 24/02/2023 contemplates appointment to grand son/grand daughter, however such appointment is in the capacity of a legal heir and not for compassionate appointment. In such an eventuality the respondents called upon the petitioner to satisfy the requirement under the Government Resolution dated 24/02/2023.

It is the case of the petitioner that the petitioner has already satisfied the requirement under Clause-3 referred above. 4.

When confronted on the issue as regards the law laid down by the Apex Court as regards the non grant of appointment in perpetuity like the one claimed in the petition (since the appointment is not compassionate appointment), Shri Raghute, learned counsel for the petitioner seeks time to address the Court on the issue.
