It is the contention of Mr. Sudame, learned Senior Counsel appearing for the petitioners that the tender document under Clause 5.2-II (page 62) and XII (page 63) provides for uploading Promoter's Profile, the Net Worth Certificate and financial credibility of the promoters. According to him, Mr. Ganesh Omprakash Agrawal is the Chief Promoter and accordingly, the documents as were contemplated under Clause - II and XII referred above were very much uploaded with the tender submitted by the petitioner for allotment of one of the plots in Akola Growth Center for which the tender was floated by respondent-MIDC. According to him, without considering the said documents, the tender is rejected citing the reason that the petitioners have not submitted the Net Worth Certificate. He would further urge that the date on which he has submitted the tender, the petitioner No.2 - Company was under the process of incorporation and the certificate of registration was issued in favour of the petitioner No.2 - Company subsequent to the
2 915.wp.1366.25 submission of the tender documents. He would claim that however such certificate is obtained subsequent to the submission of tender, the same cannot be considered as disqualified in view of clause - II and XII referred above. 2.
Issue notice to the respondents, returnable on 04.04.2025.

It is urged by Mr. Sudame, learned Senior Counsel that the petitioners have sought allotment of plot No.SZ-10, the further process of one of the plots shall be subject to outcome of the writ petition.
