In compliance with the order of this Court dated 20.03.2025, the petitioner has deposited an amount of Rs.50,000/- and the counsel appearing for the petitioner submits that pursuant to Rule 9 of the Maharahtra Land Revenue (Extraction and Removal of Minor Minerals) Rules, 1968, the petitioner shall appear before the Sub-Divisional Officer. According to him, the petitioner is not required to deposit 10% penalty amount in the District Mineral Foundation Fund as there is no statutory support for that fund. There appears to be substance in the said submission. 2.

In that view of the matter, we permit the petitioner to appear before the Sub-Divisional Officer on 13th May, 2025, so as to enable him to execute a bond as specified under Rule 9 of the Rules of 1968 and the Sub-Divisional Officer shall pass a consequential order on the very same day.
