Wankhade, Advocate i/b Mr. P.S. Wathore, Advocate for the petitioner. CORAM: NITIN W. SAMBRE & MRS.VRUSHALI V. JOSHI, JJ. DATED: 8.4.2025.
Heard.
2.
Challenge is to the communication dated 20.1.2025 whereby it is informed to the petitioner that pursuant to the Gramsabha resolution dated 12.2.2024 and in view of existing law and order issue, the petitioner shall be permitted to celebrate the event scheduled on 14.4.2025 of birth anniversary of Dr. Babasaheb Ambedkar. It is the case of the petitioner that he should be allowed to play D.J. and band which is refused by the police authorities. According to him, the same violates his fundamental rights.
3.
Once the petitioner is permitted to celebrate the birth anniversary of Dr. Babasaheb Ambedkar on 14.4.2025, we see no reason to infer violation of fundamental rights of the petitioner as he is only restricted to carry out the procession with D.J. and band. 4.
The restriction appears to be reasonable and that too upon recommendations of the Gramsabha. That being so, no case for interference is made out. Writ petition is dismissed accordingly. No costs.
