A limited grievance of the petitioners is that despite directions of the Additional Commissioner and Special Registrar, Co-operative Society, Maharashtra State, Pune to the respondent Nos.4 and 5-Bank, in relation to the one time proposal submitted by the petitioners, the Bank is not acting as per such directions.

The learned AGP, appears on behalf of the respondent Nos.1 to 3-State, points out from the affidavit filed by the respondent Nos.2 and 3 that despite such directions issued by the respondent Nos.2 and 3, the Bank is not acting upon and not complying with such directions. 4.

Though respondent Nos. 2 and 3 stated that instructions were issued and the same were not complied nd.thawre

2/2 with by the Bank, the affidavit filed by respondent Nos. 2 and 3 is silent as to what action as permissible in law is taken against the Bank.

Accordingly, we grant two weeks time to file such affidavit, pointing out what action the respondent Nos.1 to 3 have initiated against the Bank for not complying with such directions issued by the respondent Nos.2 and 3. 6.

If, upon considering the affidavit, this Court finds that respondent Nos. 1 to 3 have failed to take the action required under law in the given facts and circumstances, we may consider initiating appropriate proceedings against respondent Nos. 1 to 3.
