The challenge is to the impugned notices dated 6th March, 2025 and 19th March, 2025, issued by the respondent No.2.

By both these notices, it is claimed that the petitioner has carried out the construction by encroaching the road.

It is the case of the petitioner that the land in question was purchased from one Mr. Bankar to whom it was allotted by Vyanktesh Devasthan.

The revenue record depicts only right of possession and that no title is conferred on Mr. Bankar from whom the land was purchased by the petitioner.

Apart from above, there is hardly any material to infer that the petitioner has not carried out encroachment and illegal construction as there is no sanction from the Competent Authority.
