Drawing support from the judgment of the Hon'ble Apex Court in the matter of Prakash Kumar Jena and Ors. Vs. State of Odisha and Ors. reported in 2023 SCC OnLine SC 293, it is the contention of the learned Counsel for the petitioners that in the matter of Grah Rakshak, Home Guards Welfare Association Vs. State of Himachal Pradesh reported in (2015) 6 SCC 247 and the subsequent order/clarification dated 04.05.2016 passed in Contempt Petition (C) Nos.699-700 of 2015 by the Hon'ble Apex Court, the petitioners are entitled for the benefit of pay scale along with arrears pursuant to the observations made in para 25 therein.
