At this stage, Mr. Kaptan, learned Senior Advocate appearing on behalf of respondent no.4/the Berar General Education Society, Akola, makes a statement, on instructions, that the respondent Society wants to withdraw the impugned advertisement and issue the same afresh in accordance with the law. In that view of the matter, nothing survives in this petition. Accordingly, it is disposed off. 2.
Mr. Kaptan, learned Senior Advocate further submits that the University be directed to consider the request of respondent no.4 Society, if any, made before issuance of advertisement, within a stipulated period. He submits that such request is being made for the reason that the colleges require teaching staff immediately and this process is going on since 2017 and in absence of sufficient teachers, it is difficult to maintain the educational standard. Considering the request of Mr. Kaptan, learned Senior Advocate, we direct the University that if such proposal is received from the respondent no.4-Society for issuance of advertisement for appointment of Assistant Professors in respondent nos. 6 and 7 colleges, the same shall be considered in accordance with the law

Needless to mention that since the respondent no.4 Society has made it clear to withdraw the advertisement, the complete process will go.
