DATE : 17.02.2026 In the present petition, the petitioners have made following prayers:

"(a) Direct the respondents to grant the component of interest @ 12% per annum as enumerated under Section 23 (1-A) of Land Acquisition Act, 1894 on the market value in respect of the award dated 28.03.2008 in Land Acquisition Case No.2/2005-06 (1) of village Singaon Jahangir; (b) further direct the respondents to grant such appropriate interest on the said amount under Section 34 of Land Acquisition Act, 1894 from the date of award till the date of actual release and payment of the same to the petitioners;

(c) any other relief, which may be deemed fit in the facts and circumstances of the present case."

Mr. Kukday, learned counsel for respondent No.3, fairly concedes that similar benefits have been granted to the persons like the petitioners.

Learned counsel for the petitioners has also invited our attention to the letter at record page No.138. It is apparent from the said letter that such benefits were granted in view of the order passed in Writ Petition No.7723/2022.

Accordingly, we are of the opinion that the petitioners are entitled to equal treatment. We, therefore, direct the respondents to consider the petitioners' claim in terms of prayer clauses (a) and (b) within a period of three weeks from today. 5.

If any further information is required for compliance, respondent No.3 shall obtain the same from the petitioners within one week from today by issuing a letter to them. 6.

The decision shall be communicated to the petitioners within two weeks from the date of such decision. 7.

The writ petition is disposed of in the above-referred terms. No order as to costs.
