JUNE 10, 2025 On 28.04.2025, the Court was pleased to stay the impugned order as an interim relief with a direction to the petitioner to comply with Practice Note 14 of the Bombay High Court Appellate Side Rules, 1960, particularly clause (5) thereof. 2.

Clause (5) of Practice Note 14, puts an obligation on the petitioner's counsel to give written notice to other side of granting ad interim/interim relief by fax/speed post/telegram/registered post A.D. specifically informing the returnable date as fixed by the Court and file affidavit of service to that effect with the registry. 3.

Remark of registry indicates that the petitioner's counsel failed to comply with the Practice Note 14. Such non compliance could result in dismissal of matter in default as provided in clause (5) of Practice Note 14. Nonetheless, I am avoiding to pass order of dismissal however the lapse on the part of petitioner's counsel would entail in vacating the interim relief.

Accordingly, the interim relief granted on 28.04.2025 stands vacated. Notice issued to respondent Nos. 3 to 8 is awaited. List once these respondents are served.

Learned A.G.P. shall take note of the aforesaid order and act accordingly.
