The challenge is to order dated 5-9-2024 passed by Family Court No. 4, Nagpur directing respondent to pay interim maintenance of Rs. 10,000/- per month to the petitioner. 3.

The grievance of the petitioner is that the amount awarded is not adequate. I have gone through the order. It appears that in the statement of assets and liabilities, the respondent has disclosed his monthly income of Rs. 55,000/-. His monthly expenses were at Rs. 35,000/-, which includes installment of repayment of loan taken from his brother and expenses towards maintenance of his mother including expenses towards treatment. Accordingly, the Family Court considered all attending circumstances thought it proper to award Rs. 10,000/- per month as interim maintenance. 4.

This order cannot be said to be perverse or contrary to the provisions of law. The discretion has been used by the Family Court considering the peculiar facts of the case. No interference, therefore, is called for in the supervisory jurisdiction under Article 227 of the Constitution of India. Writ petition is dismissed with no order as to costs. (Anil L.
