Heard learned Counsel for petitioners. Nobody appears for the respondent although served.

It is pointed out that the respondent is not appearing in the instant petition, however he is prosecuting the suit before the trial Court and therefore a request is made for grant of interim relief. Having regard to the controversy involved in the instant petition and considering the submissions advanced with respect to rejection of plaint under Order 7 Rule 11of the Code of Civil Procedure, interim relief is granted in terms of prayer clause (5) till next date, which is reproduced below as under :- "(5) grant stay to the further proceeding in Reg. C.S. No.141/2023 pending before the learned Civil Judge, Junior Division, Sindkhed (Raja), during the pendency of the instant petition.".
