The petitioner's claim for issuance of the validity of 'Halba' Scheduled Tribe is rejected vide impugned order dated 03/04/2025.

We have heard the challenge to the said order for some time and expressed our disagreement with the submissions made by the learned counsel appearing for the petitioner.

On instructions, the learned counsel appearing for the petitioner states that the petitioner is giving up the challenge to the order impugned dated 03/04/2025 and shall apply for issuance of validity of belonging to 'Koshti' SBC after obtaining the caste certificate to that effect. 5.
Let the aforesaid process be completed within a period of six weeks from today. Once the caste certificate is Kavita
112-wp 2404-25.odt 2/2 received by the petitioner, the petitioner shall be at liberty to apply to the respondents for placing the services on supernumerary post in view of existing policy of the State Government.

If such request is made, based on the caste certificate of belonging to 'Koshti' SBC, the employer shall within a period of six weeks thereafter deal with the claim of the petitioner for placing the services of the petitioner on supernumerary post and communicate the appropriate order to that effect.

With the above said observations the petition stands disposed of. No costs.
