Rule. Rule is made returnable forthwith. Heard finally with the consent of the learned counsel for the parties.

We have heard Mr. S. O. Ahmed, learned counsel appearing for the petitioner, as also Mr. S. R. Puddatwar, learned counsel appearing for the sole respondent. In view of the prayer clause, which, in our view, is only to consider and decide the application dated 13.06.2022, we do not think it necessary to call for a reply from the other side, in spite of time being prayed for by them. The application dated 13.06.2022, which is pending adjudication, stakes a claim for compassionate appointment in place of the deceased father.

We therefore dispose of the petition by directing the respondent - Nagar Parishad, Khamgaon, to decide the application dated 13.06.2022, which is pending for consideration, in accordance with law. The said application to be decided within six weeks from today, and the decision thereupon shall be communicated to the petitioner.

Needless to mention that, while deciding the application dated 13.06.2022, an opportunity of hearing shall be granted to the petitioner, and the same may be decided thereafter.
