The challenge to the order dated 4.3.2025 passed by the respondent Committee is not pressed. As such, to that extent, the petition stands dismissed.

We are informed that the petitioner is served with a show cause notice having taken benefit of the caste certificate of belonging to Scheduled Tribe. According to Mr. Khubalkar, the petitioner has put in 36 years of uninterrupted service. He claims that the petitioner is served with a show cause notice dated 21.3.2025. In view of above submissions, which are borne out of record, we deem it appropriate to permit the petitioner to approach before his employer for protecting his services on supernumerary post pursuant to the policy of the State Government.

In case, if such request/representation is made within a period of two weeks from the date of this order, we direct the respondent-employer to take a decision on it, having regard to the policy of the State Government, as expeditiously as possible and in any case, within a period of six weeks from the date of said
wp2559.2025.odt representation. Till then there shall be no coercive action against the petitioner.
