Heard the learned counsel for the petitioner. 2.

The order of black-listing the petitioner for three years, who is running rice mill, is under challenge in this petition.

The petitioner was appointed for milling and supplying the rice. On finding 5631.50 quintals rice less in the inspection report of the SDO and less electricity was used while milling the rice and received excess of delivery order than the Bank Guarantee, it was presumed that the misappropriation was made by the petitioner.

Accordingly, a show-cause notice was issued to the petitioner on 17.04.2025, to which the petitioner replied on 29.04.2025. The petitioner denied all the allegations

2/3 and submitted his explanation to every charge. On 30.04.2025 i.e. on the next date, the order of black listing was passed against the petitioner.

In the impugned order, except the sentence that the reply of the petitioner was not found satisfactory, there is no discussion about the stand taken by the petitioner or why such stand was not found satisfactory.

Moreover, in all the subsequent inquiries conducted, none of the charges were found to be substantially proved. 7.

In the circumstances, we are of the opinion that the decision of the respondent-Collector, black listing the petitioner was taken in hasty manner and without recording sufficient reason for not accepting the explanation offered by the petitioner.

In the circumstances, we pass the following order: (i) The application is partly allowed.

(ii) The order dated 30.04.2025 passed by the Collector, Gadchiroli, is hereby quashed and set aside.

(iii) The Collector, Gadchiroli shall be at liberty to hear the petitioner and, after considering the reports of the subsequent inquiries regarding the quantity of

3/3 rice as well as the consumption of electricity, take decision afresh.

The petition is disposed of in the above terms. 10.

The pending civil application, if any, stands disposed of.
