The petitioner has approached this Court seeking direction to respondent No.2 to hold and declare that the post of District Program Manager for Amravati District is reserved for SC category candidate and further direction to respondent Nos.1 to 4 to appoint the present petitioner on the post of District Program Manager for Amravati District.

The learned counsel for the petitioner submits that during pendency of the present writ petition, the petitioner had approached to the Maharashtra State Scheduled Castes/Tribes Commission pointing out the aforesaid grievance that the post of District Program Manager for Amravati District was reserved for SC category since 2022 and for the first time in the impugned advertisement it is reserved for ST category. Accordingly, the Commission after considering the grievance of the petitioner has passed the order on 29/05/2025 which is communicated vide communication dated 18/06/2025 (page 7 Annexure-A to CA/26/2026).

Shri Kadu, learned counsel submits that by virtue of aforesaid communication/order, the Commission has directed the respondents, specifically respondent No.2 to consider the aforesaid order and the fact that the concerned post should have been reserved for SC category.

In view of above, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to file a detail representation to respondent No.2 in view of the order passed by the Maharashtra State Scheduled Castes/Tribes Commission for the aforesaid relief.

Permission is granted.

If such representation is made to respondent No.2, same shall be considered and decided by respondent No.2 within a stipulated period of six weeks from the date of receipt of such representation taking into consideration the order dated 29/05/2025 passed by the Maharashtra State Scheduled Castes/Tribes Commission and granting opportunity of hearing to the petitioner if so desired.

The decision taken shall be communicated to the petitioner within a period of two weeks thereafter. 6.

Writ petition is disposed of with liberty as prayed. No order as to costs.

In view of the order passed on writ petition, CA/26/2026 stands disposed of.
