The plaintiffs in Regular Civil Suit No.10/2024, who are petitioners herein had filed application vide Exh.30 in the said civil suit, inter alia praying for order of temporary injunction, restraining the defendants from making construction over the suit property. The said application was allowed by the learned Joint Civil Judge, Junior Division, Lakhani vide order dated 12/03/2025. Vide judgment and order dated 02/05/2025, the appeal came to be allowed, by virtue of which the order of temporary injunction dated 12/03/2025, passed by the learned Trial Court came to be set aside and the application filed vide Exh.30 came to be rejected. This judgment and order dated 02/05/2025, passed by the learned District Judge-1, Bhandara in Misc. Civil Appeal No.11/2025 is under challenge in the present petition. 2.

Learned Advocate for the respondent/defendant No.3 states that the construction is almost over.

Learned Advocate for the petitioners/plaintiffs does not dispute this statement.

In view of the aforesaid, it is directed that construction made by the defendant No.3/respondent shall be subject to final outcome of the civil suit.

Writ Petition is disposed off accordingly with no order as to costs.
