The petitioners seek a direction to the respondents to take appropriate steps for renewal of the lease of land bearing Survey No.43, Sheet No.11, admeasuring 16,592 sq. mtrs., Mouza Kamptee, Tahsil Kamptee, District Nagpur, in an expeditious manner.

The contention is that, on 16th September, 2022, the petitioner, for and on behalf of all the petitioners, applied to respondent No.3 for renewal of the lease of the aforesaid land, contending that they have been in possession of the said land since the year 1952 and that on earlier occasions such lease had also been renewed.

Mr. Gadhia, learned counsel for the petitioners, submits that, pursuant to the aforesaid application dated 16th September, 2022, respondent No.3 processed the same by issuing a

107.WP.2972.2026 2/2 proclamation inviting objections from the public to the proposed renewal of the lease, and no such objections were received. He further submits that the petitioners have deposited all necessary processing charges for the lease renewal application and undertake to pay all requisite charges for such renewal. However, the aforesaid application is pending pending since September 2022, and more than three and a half years have elapsed without any decision.

In view of the above, the petitioners approached respondent No.1 - State of Maharashtra, pointing out the delay in processing the application for renewal of lease and requesting expeditious disposal thereof. The said representation was submitted on 21st August, 2024, which is at record page No.49 (Annexure-P).

In view of the above, we dispose of the present writ petition with a direction to the respondents to process and decide the application for renewal of lease submitted by the petitioners on 16th September, 2022, more particularly in light of the grounds raised in the representation dated 21st August, 2024, within a stipulated period of eight weeks from the date of production of this order. The decision taken thereupon shall be communicated to the petitioners within two weeks thereafter. 7.
