JUNE 13, 2025 The argument is that respondent no.2 made an apparent error by issuing notice for special meeting under Section 35(2) of the Maharashtra Village Panchayats Act, 1959 (for short "Act of 1959"), despite the fact that the Gram Panchayat under question is in a scheduled area and, therefore, provisions of Chapter III, more particularly Section 54D of the Act of 1959, will apply.

2] Issue notice to the respondents returnable on 27/6/2025.

3] The learned A.G.P. waives notice for respondent nos. 1 and 2.

4] In addition to usual mode, the petitioner shall serve the respondents through speed post and file affidavit of service.

5] The learned Counsel for the petitioner submits that no-confidence motion was passed against the petitioner and she has been removed and fresh elections are declared and will be held today.

8-WP-2990-2025 6] The learned Counsel, as such, insists for interim relief. However, considering the fact that the order impugned is dated 9/4/2025, there appears no reason why should the petitioner approach this Court belatedly. Hence, no interim relief. However, the election of Sarpanch, that will be held today, will be subject to the outcome of the petition.
