Argument is that respondent - wife has obtained the impugned order of interim maintenance by suppressing material facts. Counsel for petitioner submits that in the statement of assets and liabilities filed along with affidavit by the respondent before the Family Court, Nagpur, she has not disclosed that she is a working lady. He further submits that earlier she was working and earning Rs.20,000/- per month, which fact has been acknowledged by the Family Court. However, she has left the said job and projected herself to be unemployed in an affidavit of assets and liabilities filed before the Family Court. She has then joined another service, which fact too is said to have been suppressed.

On the strength of submissions that the wife obtained the order of interim maintenance by suppressing material facts, issue notice to the respondent, returnable in three weeks. The petitioner shall, however, deposit in the Court 50% of the arrears of maintenance within two weeks from today, failing which, the petition shall stand dismissed without further reference to the Court.
