The impugned order indicates that the petitioner was absent despite repeated calls when the matter was listed before the trial Court. Accordingly, application for permission to file written statement was rejected.

As such, I do not find perversity in the approach. However, to not permit the party to file written statement will affect its right to contest the suit.

Issue notice, returnable in three weeks.

The petitioner shall, however, deposit in this Court Rs. 10,000/- within one week from today, failing which, the petition shall stand dismissed without further reference to the Court.
