Heard Ms. Kirti Satpute, learned counsel for the petitioner.

Nobody appears for the respondent though served. Record reveals that the respondent is served by notice on interim relief.

The petitioners have raised challenge to order dated 15.11.2024 passed by the trial Court on application for temporary injunction and also order dated 1.4.2025 passed by the Appellate Court deciding the Misc. Civil Appeal challenging the order on injunction application.

Learned counsel for the petitioners points out that the impugned orders are passed mainly on the basis of spot inspection report dated 10.6.2024 which records that there existed some drain on the property bearing Survey Nos.105 and

107. The suit is with respect to the suit property bearing Survey Nos.107, 108 and 110. As such, it is submitted that only by relying upon the said spot panchanama the trial Court

46-wp3232.25.odt 2/2 as well as the Appellate Court has decided the application for injunction without considering the other relevant factual aspects.

Since nobody appears for the respondent, despite service of notice on interim relief, interim relief in terms of prayer clause (v) is granted till next date of hearing. 6.
