The petitioner's request, who were the original defendant Nos.1-B to 1-D, before the trial Court, seeking amendment to written statement has been rejected by the trial Court saying that the petitioners being legal representatives of the original defendant No.1 cannot take contrary stand in written statement.

The argument is that by way of amendment, the petitioners had not taken a contrary stand but only elaborated the pleadings on the point of modus operandi of the respondent No.1 / plaintiff.
