In this petition the case of the petitioner is that long before the sale deed, the possession of the land in question was taken and payment was made at the time of sale deed, hence, the petitioner is entitled for compensation from the date of possession.

We find that the present matter involves many disputed questions of facts, particularly the recital in the sale deed itself stating that possession of the land was handed over on the date of execution of the sale deed, which the petitioner is denied. 3.

Learned counsel for the petitioner supplied certain photographs showing a display board which was erected on the site shows some different dates. Such issue cannot be decided in the writ petition.

Accordingly, considering the fact that there are many disputed questions of facts are involved, the petition is disposed of with liberty to the petitioner to file appropriate proceedings before the appropriate forum, if the petitioner so desires. (RAJ. D. WAKODE, J.) (ANIL S. KILOR, J.) MJ Jadhav
