The petitioner has been disqualified for having third child. The argument is that the first child shown to be born to the petitioner is incorrect. Learned counsel for the petitioner has referred to Ekatmik Bal Vikas Seva Yojna, which is relied upon by the authorities below to render a finding that the child mentioned in the said document is of petitioner. The relevant entry is at serial no. 59. The name of mother is mentioned as Roshni, the caste as OBC and date of birth of child as 14-11-2013.

Learned counsel for the petitioner submits that his wife is Muslim and, therefore, caste cannot be OBC. Issue notice, returnable in three weeks.

Learned Assistant Government Pleader waives notice for respondent nos. 1 and 2.

Learned counsel for the petitioner makes a request for interim relief. However, considering the fact that the order impugned refers to another document viz. report of Health
