The Petitioner - a registered Public Trust appears to be managing the Educational Institution in which there exists a dispute about the seniority of the teaching staff. Such dispute is referred by the Petitioner to the Respondent No. 1 vide communication dated 19/03/2025 and it appears that an ad-hoc arrangement is made thereby granting powers in favour of the Respondent No. 2 on the post of Headmaster. (2) It is the case of the Petitioner that the grievance forwarded by it to the Respondent No. 1 is not decided and the same is affecting the working of the Institution.

21wp3299.25 21wp3299.25 (3) The fact remains that on temporary basis, the Education Officer has addressed the issue by conferring powers to the Respondent No. 2, so as to process the necessary documents viz. the salary bills and other requirements, as contemplated under the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977, to be reported to the Education Officer.
(4) However, since the Petitioner intends to have a permanent solution to this issue, we deem it appropriate to dispose of the Petition. We hereby direct the Respondent No. 1 - Education Officer to decide the Representation dated 19/03/2025 viz. the dispute referred by the Petitioner in regard to the seniority list of the teaching staff, as expeditiously as possible and in any case within a period of three months from the date of the production of this order. The order is passed keeping in mind that in case, if the dispute about seniority is not already decided, it can be decided as ordered hereinabove. (5) Accordingly, the Writ Petition stands disposed of. (6) We dispense with the notice to the Respondent No. 2, as the order passed above in innocuous.
