It is the case of the petitioner that she was more meritorious than the respondent No.5 who is promoted from the post of Assistant Anganwadi Sevika to that of Anganwadi Sevika.

The entire issue in our opinion is governed by the mandate provided in the Government Resolution dated 13th August, 2014 which equally provides for mechanism in case if there is a grievance about the selection process in the matter of appointment. Though the learned counsel for the petitioner has claimed that the policy is applicable to the appointment and not to the promotional post, we have reason to disagree with such submission on the ground that the

11.WP.3489.2025.odt 2/2 intention behind providing mechanism in the Government Resolution dated 13th August, 2014 is to redress the grievance in the matter of appointment so also the promotion. 4.

The very mechanism provided for redressal of grievance vide Government Resolution dated 13th August, 2014, in our opinion, can be extended to the appointment which are made by promotion also.

That being so, we deem it appropriate to dispose of the present petition with following order:

ORDER

(i) We permit the petitioner to appear before the Authorities, who are prescribed in the Government Resolution dated 13th August, 2014, for the purpose of redressal of her grievance which is sought to be canvassed in the petition. (ii) In case the petitioner takes the proceedings before the Authority as provided in Clause 6(A) of the Government Resolution dated 13th August, 2014, within a period of one week from today, we direct the said Authority to decide the grievance of the petitioner within a period of six weeks from the date of the appearance of the petitioner. 6.

The petition accordingly stands disposed of. No order as to costs.
