The learned Counsel for the petitioner submits that as per the perspective plan, there was a requirement of four colleges for General Nursing & Midwifery course. However, the application made by the petitioner for the said course in the year 2021 was not considered on the ground that as per the perspective plan, sufficient colleges have been approved. Further, it is stated that the application was not considered on the ground that it was not submitted within the stipulated time period. According to him, this ground is not tenable in view of the acknowledgment received by the petitioner, which shows that it was presented within the stipulated period.

Furthermore, it is argued that though there was a requirement of four colleges, the number of colleges, which have been approved, are much more than

40-WP-3681-2025 the colleges required as per the perspective plan. He, therefore, submits that on both these grounds, the rejection of the application of the petitioner is not tenable.

In that view of the matter, issue notice to the respondents, returnable on 7th August, 2025. 5.

The learned A.P.P. waives service of notice for respondent No.1/State.

The petitioner is permitted to serve the respondent No.2 by private mode, in addition to regular mode of service and shall file an affidavit of service by next date.
