JULY 17, 2025 The learned Counsel for the petitioner submits that no-confidence motion has been passed against the petitioner - Sarpanch. He has invited my attention to Rule 2 of the Bombay Village Panchayats Sarpanch and Up-Sarpanch (No Confidence Motion) Rules, 1975. Sub-rule (2) of Rule 2 provides that the Tahsildar shall send one copy of notice of no-confidence to the Sarpanch. The Tahsildar, however, has not forwarded copy of such notice and, thus, the petitioner was unaware of the reason why no-confidence motion is being moved against him, and accordingly, was deprived of his valuable right to answer the no-confidence motion. 2] Issue notice to the respondents returnable on 31/7/2025.
3] The learned A.G.P. waives notice for respondent nos. 1 to 3.
4] In addition to usual mode, the petitioner shall serve the respondents through speed post, and file affidavit of service.
